  • You’ll need to create an account with accurate information and keep your login details secure.
  • IOIA provides access to course materials through its online learning platform, but availability and response times for technical support are not guaranteed.
  • IOIA owns all course content and online materials.
  • The courses are provided “as-is,” and IOIA is not responsible for losses or damages resulting from use of the platform or materials, except where the law does not allow those limits.
  • IOIA may update these Terms from time to time, and different laws may apply depending on the type of course you are taking.

1. Introduction and Acceptance of Terms

This agreement applies as between you, the User of this Website/e-learning platform, and International Organic Inspectors Association (IOIA), the owner(s) of this Website. Your agreement to comply with and be bound by Clauses 1, 2, 4–11 and 15–25 of these Terms and Conditions is deemed to occur upon your first use of the Website. Clauses 3 and 12–14 apply only to the sale of Services. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.
No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and Our acceptance of that offer is deemed to occur upon Our sending a confirmation email to you indicating that your order has been accepted.

2. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

“Account”: means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and/or any communications System on the Website;
“Content”: means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
“Facilities”: means collectively any online facilities, tools, services or information that International Organic Inspectors Association makes available through the Website either now or in the future;
“Services”: means the services available to you through this Website, specifically use of the International Organic Inspectors Association proprietary e-learning platform;
“Payment Information”: means any details required for the purchase of Services from this Website, including but not limited to credit/debit card numbers, bank account numbers and sort codes;
“Premises”: means Our place(s) of business located at 117 North Park Avenue, Broadus, Montana, 59317 USA;
“System”: means any online communications infrastructure that International Organic Inspectors Association makes available through the Website either now or in the future, including but not limited to web-based email, message boards, live chat facilities and email links;
“User” / “Users” and/or “Learner”/ “Learners”: means any third party that accesses the Website and is not employed by International Organic Inspectors Association Ltd and acting in the course of their employment;
“Website”: means the website/e-learning platform that you are currently using (ioiaonlinetraining.learnworlds.com) and any sub-domains of this site unless expressly excluded by their own terms and conditions; and
“We/Us/Our”: means International Organic Inspectors Association, a company incorporated in the United States with Company registration number 41-1764464, located at 117 North Park Avenue, Broadus, Montana 59317 USA.

3. Course Eligibility and Learner Verification

By registering for IOIA self-paced online courses, you verify that you meet the minimum inspection experience required for the course level selected:

• 100-level self-paced courses:
No minimum inspection experience required.
• 200-level self-paced courses:
Completion of IOIA’s 100-level in-person or live online basic inspection course in the same scope (crop, livestock, or handling); and
Completion of a minimum of 10 organic inspections or 10 final reviews for organic certification.
• 250-level self-paced courses:
Completion of IOIA’s 100-level in-person or live online basic inspection course in the same scope (crop, livestock, or handling); and
Completion of a minimum of 10 organic inspections or 10 final reviews for organic certification.
• 300-level self-paced courses:
Completion of a minimum of 20 organic inspections or 20 final reviews for organic certification within a two-year period.

By submitting your registration, you confirm that you are registering for one person only and that you will not share course access or materials with others.

4. Accounts and User Responsibilities

4.1 Account Creation and Accuracy
In order to procure Services on this Website and to use certain other parts of the System, you are required to create an Account. By continuing to use this Website you represent and warrant that:
• all information you submit is accurate and truthful;
• you have permission to submit Payment Information where required; and
• you will keep this information accurate and up-to-date.

4.2 Account Security
It is recommended that you do not share your Account details, particularly your username and password. We accept no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
If you believe your Account details have been obtained without consent, you must contact Us immediately. Orders or payments can only be cancelled up until provision of Services has commenced. Charges may apply for Services already provided.

4.3 Username Standards
When choosing your username you are required to adhere to the terms set out in Clause 5 below. Failure to do so may result in suspension or deletion of your Account.

5. Use of Communications Facilities

When using any System on the Website, you must comply with the following rules. Failure to do so may result in your Account being suspended or closed:

• Submissions should be made in English;
• You must not violate any applicable laws or these Terms and Conditions;
• You must not impersonate other people, particularly employees or representatives of International Organic Inspectors Association or its affiliates;
• You must not use the System for unauthorised mass communications such as spam or junk mail.

We reserve the right to monitor, retain, and modify communications made through Our System. You waive any moral right to be identified as the author of such information.

6. License to Use Course Materials

IOIA grants you a personal, non-transferable, non-exclusive license to use the self-paced learning modules solely for your own training. You may not copy, distribute, resell, share, modify, decompile, reverse engineer, disassemble, or create derivative works from the Module without prior written consent from IOIA.
You must keep your access credentials confidential and may not provide access to any other person except as expressly permitted in writing by IOIA.

6.1 Restrictions
You may not reproduce, copy, distribute, store, or reuse Website material without Our express written permission unless otherwise indicated.

7. Intellectual Property

All Content and all rights, including copyright, trademark, and other intellectual property rights in the Module and Website, belong solely to International Organic Inspectors Association, its affiliates, or relevant third parties and are protected by applicable intellectual property laws. Reuse is prohibited without express permission.

8. Links to and from Other Websites

This Website may contain links to third-party sites. We assume no responsibility for their content. Linking to the Website home page is permitted without prior permission; deep linking requires express written permission from IOIA.

9. Services, Pricing, and Availability

We make reasonable efforts to ensure accurate Service descriptions. Prices are correct at the time of publication and may change. The price valid at the time of your order will apply.

10. Orders and Provision of Services

Your order constitutes an offer that We may accept by issuing an order confirmation email. 
Services will begin after acceptance and Payment.
International Organic Inspectors Association will provide Services with reasonable skill and care and offer technical support via email from the Program Administrator without guaranteed response times.
Additional terms may apply to certain Services and will be presented at the time of purchase.

11. Termination and Cancellation of Accounts

Either party may terminate an Account. If We terminate your Account, pending orders will be cancelled and Services will not commence.

12. Privacy and Personal Information

Use of the Website is governed by Our Privacy Policy, which is incorporated by reference. We collect, use, and store personal information in accordance with applicable data protection laws and use it to provide Services, process payments, and communicate with you.

13. Disclaimers

The Website and Services are provided “as is” and “as available.” We make no warranties regarding fitness for purpose, accuracy, compatibility, or specific outcomes. Content does not constitute advice.

14. Changes to the Website and Terms

• loss or corruption of data; or
• any indirect or consequential loss.

This limitation of liability is acknowledged by all parties as a reasonable allocation of risk and reflects that IOIA could not provide the Services without this limitation.
Nothing in these Terms and Conditions excludes or restricts liability where it cannot be lawfully excluded. If any provision is found unenforceable, the remaining Terms shall remain in full force and effect. To the maximum extent permitted by law, We accept no liability for losses arising from use of the Website or Services, except where liability cannot be lawfully excluded.

21. Law and Jurisdiction

21.1 Website Use
Use of the IOIA Website/e-learning platform, including browsing, account creation, and access to general content, is governed by and construed in accordance with United States and State of Montana laws.

21.2 Self-Paced Learning Modules
Use of IOIA self-paced online training Modules is governed by and construed in accordance with the laws of the United States and the State of Montana. Any dispute arising out of or in connection with self-paced learning Modules shall be litigated in Montana.
By using the Website and/or enrolling in self-paced learning Modules, you agree to submit to the applicable jurisdiction as described above.
These Terms and Conditions shall be governed by and construed in accordance with United States and State of Montana laws. You agree to submit to the exclusive jurisdiction specified herein for any disputes arising under these Terms and Conditions.
